CRITERIA FOR GIVING LEGAL SERVICES

 

Every person who has to file or defend a case shall be entitled to legal services if that person, is-

  1. a member of a Scheduled Caste or Scheduled Tribe;
  2. a victim of trafficking in human beings or beggar as referred to in Article 23 of the Constitution ;
  3. a women or a child;
  4. a person with disability as defined in clause (I) of Section 2 of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act. 1995;
  5. Disability Means:-
    1. blindness;
    2. low vision;
    3. leprosy-cured;
    4. hearing impairment;
    5. locomotors disability;
    6. mental retardation;
    7. mental illness;
  6. a person under circumstances of underserved want such as being a victim of a mass disaster, ethnic violence, caste atrocity, flod drought, earthquake or industial disaster;
  7. an industial workman;or
  8. a person in custody, including custody in a protective home within the meaning of clause (g) of Section 2 of the Imoral Traffic (Prevention)Act 1956 or in a juvenile Home (Observation Homes, Special Homes, Place of Safety, Children Homes) within the meaning of Section 47,48,49,50 of the Juvenile Justice (Care and Protection of Children) Act 2015 or in a psychiatric hospital or psychiatric nursing home within the meaning of Clause (g) of Section 2 of the Mental Health Act 1987
  9. in case of great public importance; or
  10. in special case, reasons for which to be recorded in writing which is considered otherwise deserving of legal service;
  11. Transgender People;
  12. a Senior Citizen of India who has attained the age of 60 years or above
  13. Cancer Patient;
  14. H I V Patient;
  15. Any citizen of India whose annual income from all sources dose not exceed Rs. 150000/- (One Lakh Fifty thousand) shall be entitled to get legal services
